Terms of Use

1. About these terms

These Terms of Use ("Terms") govern your access to and use of the glowkaki website (the "Site"), operated by glowkaki ("we", "us", "our"). By browsing the Site, creating an account, posting a review or submitting a business listing, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

2. What we are, and are not

The Site is an online directory that helps people discover independent, home-based beauty and grooming businesses in Singapore ("Listed Businesses"). We publish information about Listed Businesses so that clients can contact them directly.

Any agreement for services is made solely between the client and the Listed Business. That business alone is responsible for the services it provides, including their quality, safety, hygiene, pricing, timing, cancellation terms and any refunds.

We review listings before they appear, but this review is limited to checking that a submission looks complete and suitable for the directory. It is not an inspection, audit or verification of a business's qualifications, licences, premises, products, insurance, identity or track record. Badges, featured placements and editorial descriptions reflect our general impressions only and are not guarantees or endorsements.

3. For clients

Before booking any treatment, you are responsible for satisfying yourself that the business and the treatment are suitable for you. In particular, we encourage you to:

• ask the business about their training, experience, licences and the products they use;
• tell the business about any allergies, skin conditions, pregnancy, medications or other health matters, and ask for a patch test where appropriate;
• consult a doctor before any treatment if you have medical concerns;
• confirm prices, deposits, cancellation terms and the address directly with the business; and
• take sensible precautions for your personal safety when visiting a private home or inviting someone into yours.

Treatments such as eyelash extensions, brow embroidery, chemical peels, waxing, IPL and other procedures carry inherent risks, including allergic reactions, irritation, infection and unsatisfactory results. You choose to undergo any treatment at your own risk.

Appointment requests are enquiries only. When you use "Ask for an appointment", the Site helps you write a message with your preferred service, days and times and opens WhatsApp or email so you can send it yourself. Sending a request does not book, reserve or hold any appointment, and nothing is paid through the Site. An appointment exists only once you and the business have agreed a date and time directly with each other. Availability shown on a listing is a general guide supplied by the business and may not be current. We do not see or keep your conversation with the business, and we are not responsible for whether, when or how a business replies.

4. For listed businesses

If you submit a business listing, you confirm and agree that:

• you are authorised to list the business, and everything you submit (including prices, address, photos and descriptions) is true, accurate, not misleading and kept up to date;
• you own or have permission to use every photo and piece of content you submit, and it does not infringe anyone else's rights;
• you hold, and will maintain, every licence, permit, approval, qualification and insurance required to run your business and provide your services, and you comply with all applicable laws and rules, including any rules on running a business from a residential home (such as HDB or condominium rules), health and safety, consumer protection and personal data;
• you are solely responsible for your services, your premises, your products, your staff and your dealings with clients;
• the availability and reply time you show are a general guide only, and you will respond to appointment requests directly with the client; and
• we may approve, decline, edit for clarity or formatting, feature, suspend or remove any listing at our discretion, with or without notice.

Listing on the Site is currently free. We may introduce paid features in future, but will not charge you without your agreement.

5. Accounts

You must be at least 18 years old to create an account, post a review or submit a listing. You are responsible for keeping your login details confidential and for all activity under your account. Tell us promptly if you suspect unauthorised use. We may suspend or close accounts that breach these Terms.

6. Reviews and content

Reviews and ratings must reflect your genuine, first-hand experience. Do not post reviews of your own business or a competitor's, reviews you were paid or rewarded for, or content that is false, defamatory, abusive, discriminatory, obscene, or that reveals someone else's personal information.

Reviews are the opinions of the members who post them, not our opinions. We do not verify reviews and are not responsible for their content. We may remove or decline to publish any review or content at our discretion.

You keep ownership of content you submit. You grant us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, adapt (for example, resize or crop) and publish that content on the Site and in promoting the Site, for as long as it remains on the Site and for a reasonable period afterwards.

7. Acceptable use

You must not:

• use the Site for any unlawful, fraudulent or harmful purpose;
• submit false listings, impersonate any person or business, or misrepresent your affiliation;
• scrape, copy, harvest or re-publish listings or personal information from the Site, or use it to send unsolicited marketing;
• interfere with the Site's security or operation, or try to access accounts or data that are not yours; or
• upload malicious code or content that infringes anyone's rights.

8. Assumption of risk

Beauty, grooming and cosmetic treatments carry inherent risks, including allergic and skin reactions, irritation, infection, burns, hair or lash damage, scarring and results that differ from what you expected. Some treatments (for example, brow embroidery, chemical peels, radiofrequency, IPL and waxing) carry higher risks. Visiting a private home, or inviting someone into yours, also carries personal safety risks.

You understand and accept these risks. You decide for yourself whether to contact, book with, visit, pay or receive services from any Listed Business, and you do so voluntarily and entirely at your own risk.

9. Disclaimer of warranties

The Site, its content and all information about Listed Businesses are provided on an "as is" and "as available" basis, without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, representations and conditions, whether express, implied or statutory, including any implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, accuracy and quiet enjoyment.

Without limiting the above, we do not warrant, represent or guarantee:

• the identity, qualifications, training, experience, licences, permits, insurance, hygiene standards, premises, equipment or products of any Listed Business;
• the quality, safety, legality, suitability or results of any service or treatment offered by a Listed Business;
• that any listing, price, service menu, photo, address, MRT information, opening arrangement, badge, review or rating is accurate, complete, genuine or current;
• that any Listed Business will respond to you, honour a price or booking, or remain in business; or
• that the Site will be uninterrupted, timely, secure, error-free or free of viruses or other harmful components, or that defects will be corrected.

Badges, "featured" placements, shortlists and editorial descriptions reflect our general impressions only. They are not endorsements, certifications or recommendations that a business is safe or suitable for you. Nothing on the Site is medical, health, skincare, legal or other professional advice, and it should not be relied on as such. Any reliance you place on information on the Site is at your own risk.

10. Disputes with businesses

Because we are not a party to any arrangement between you and a Listed Business, any complaint, claim or dispute about a service, treatment, price, payment, deposit, refund, cancellation, injury, property or conduct must be resolved directly between you and that business.

To the fullest extent permitted by law, you release us, and our owners, officers, employees, contractors and agents, from all claims, demands, losses and damages of every kind, known and unknown, arising out of or connected with any such dispute or with the acts or omissions of any Listed Business or other user.

We are not obliged to investigate or mediate, but we welcome reports about a listing and may suspend or remove it at our discretion. For consumer disputes you may contact the Consumers Association of Singapore (CASE) or the Small Claims Tribunals; for injury or health concerns, please see a doctor.

11. Limitation of liability

To the fullest extent permitted by law:

1. No liability for Listed Businesses. We are not liable for any loss, damage, injury, illness, cost, expense or claim of any kind arising out of or in connection with any service, treatment, product, advice, premises, staff or conduct of a Listed Business or any other user, or any booking, payment, communication or visit between you and them.
2. No liability for information or the Site. We are not liable for any loss arising from your reliance on any listing, review, rating or other information on the Site, or from your use of, or inability to use, the Site, including any error, omission, interruption, delay, data loss, virus or unauthorised access.
3. No indirect losses. We are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, or for any loss of profit, revenue, business, contracts, goodwill, reputation, data or anticipated savings, however arising and whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if we were advised of the possibility.

These limits reflect that the Site is a free directory, that we do not provide or control the services listed on it, and that you are best placed to assess and manage the risks of the services you choose.

Your use of the Site is entirely voluntary and free of charge. You are not required to use the Site, or to contact or book with any Listed Business through it. If you are dissatisfied with the Site, any of its content or these Terms, your sole and exclusive remedy is to stop using the Site.

12. Indemnity

You agree to defend, indemnify and hold harmless us and our owners, officers, employees, contractors and agents from and against any claim, demand, action, loss, liability, damage, fine, penalty, cost and expense (including reasonable legal fees on a full indemnity basis) arising out of or relating to:

• your use of the Site, or any content you submit;
• your breach of these Terms or of any law, or your infringement of anyone else's rights;
• your dealings with any Listed Business or other user; and
• if you are a Listed Business, your services, treatments, products, premises, staff, licensing, pricing and conduct, and any claim by a client relating to them.

We may take control of the defence of any matter covered by this indemnity, and you agree to cooperate with us.

13. Time limit for claims

To the extent permitted by law, any claim against us arising out of or relating to the Site or these Terms must be brought within one year after the cause of action arises. Otherwise, the claim is permanently barred.

14. Third-party services

The Site links to and relies on services we do not control, such as WhatsApp, Google Maps, Instagram, email providers, Google reCAPTCHA and Wix (which hosts the Site and its member accounts). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

15. Changes and termination

We may change, suspend or discontinue any part of the Site at any time. We may update these Terms from time to time by posting the new version here with a new effective date. If you keep using the Site after an update, you accept the updated Terms. We may suspend or end your access at any time if you breach these Terms.

16. Governing law

These Terms are governed by the laws of Singapore. You and we submit to the non-exclusive jurisdiction of the courts of Singapore.

17. General

If any part of these Terms is found unenforceable, the rest remains in effect, and the affected part applies to the maximum extent permitted. Our failure to enforce a right is not a waiver of it. These Terms and our Privacy Policy are the entire agreement between you and us about the Site. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 2001 to enforce any of them.
